For years, a separate system for juveniles in the U.S. was a matter of hot debate. Although maintaining a separate system for juveniles is associated with significant costs, it is clear that the arguments in support of the separate system are more compelling than those against it.
The need for a separate system for juveniles is justified by several reasons. First, juveniles are still young, and are more susceptible to the influence of various social and criminal factors; in other words, it is more probable that under the impact of treatment programs juveniles will change for the better (Clear, Cole & Reisig, 2008). Second, juveniles are prone to look at adults as an example (regardless of whether this example negative or not), and this high rate of “desistance” among juveniles makes the separate system effective, necessary, and justified (Clear, Cole & Reisig, 2008). Third, correctional programs for juveniles often involve families, because families for juveniles is the critical component of effective treatment programs – the aspect, which is almost impossible in adult corrections (Clear, Cole & Reisig, 2008). Fourth, the need for a separate juvenile system is specifically designed to address group behaviors among younger people, because, in distinction from adults, they lack stimuli to withstand the effects of socialization and their desire and pressure to engage in group criminal acts (Clear, Cole & Reisig, 2008). Finally, while adults can successfully adjust to their social roles and reintegrate with the community, everything is not so easy for juveniles (Clear, Cole & Reisig, 2008). Although a separate system of juveniles is expensive and troublesome, and can even be impossible because of the limitedness of available resources (O’Connor,, Rausch & Albrecht, 2007), there is an urgent and never ending need to maintain and preserve this system.
